Welcome to Nicole Schmitz Studio (“we,” “our,” or “the Artist”). By commissioning or purchasing artwork, engaging our services, or interacting with our content, you (“the Client”) agree to the following terms:

We offer custom artwork, live painting, and/or other creative services. All works are crafted with care and tailored to your specifications within the agreed-upon scope.

2. Booking and Payments

• Booking Confirmation: Your booking is confirmed once a deposit (if applicable) or full payment is received.

• Payment Terms: Payments are due as outlined in the invoice. Failure to pay within the specified timeframe may result in cancellation.

• Deposits: Deposits are non-refundable.

3. Refunds and Cancellations

• Due to the personalized nature of our services, all sales are final, and no refunds will be issued.

• Cancellations must be communicated in writing. Rescheduling is subject to the Artist’s availability.

4. Creative Process

• Client Input: You may provide guidance on the desired style, colors, and themes. The final interpretation of the artwork remains at the discretion of the Artist.

• Artistic Freedom: The Artist reserves the right to incorporate creative elements that best suit the project while honoring your requests.

5. Delivery and Ownership

• Delivery: Artwork will be delivered within the agreed timeframe, unless delays arise due to unforeseen circumstances.

• Ownership of Originals: The Client receives the physical artwork. The Artist retains copyright and reproduction rights unless otherwise agreed in writing.

• Digital Copies: Any digital files provided are for personal use only.

6. Copyright and Usage Rights

• The Artist retains full copyright to all artwork created.

• Artwork may not be reproduced, distributed, or used for commercial purposes without explicit permission from the Artist.

• The Artist reserves the right to use the artwork for promotional purposes, unless otherwise agreed in writing.

7. Limitation of Liability

The Artist is not liable for any damage, loss, or delays once the artwork has been delivered to the Client or a third party (e.g., shipping provider).

8. Confidentiality

Any personal or project-related information shared by the Client will be treated as confidential and used solely for the purposes of delivering the commissioned work.

9. Dispute Resolution

Any disputes arising from this agreement will be resolved amicably. If resolution cannot be achieved, disputes will be subject to the laws and jurisdiction of [Artist’s Location].
